LIVING TRUST

A living trust, also known as a revocable trust, is an estate planning tool that holds and manages assets during a person’s lifetime and provides for the distribution of those assets upon their death.

These are some of benefits of having a living trust:

  • Avoidance of probate. Probate is the legal process through which a court oversees the distribution of a person’s assets after their death. Assets held in a living trust can pass directly to beneficiaries without going through probate, saving time and money.
  • The administration of a living trust is a private matter. The details of the trust, including asset distribution and beneficiaries, remain private, providing a level of confidentiality that probate does not offer.
  • The grantor of a living trust retains control over the assets during their lifetime. They can make changes to the trust, add or remove assets, and even revoke the trust if circumstances change. This flexibility allows for ongoing control over the estate plan.
  • In the event of the grantor’s incapacity, the successor trustee named in the living trust can seamlessly take over the management of trust assets. This avoids the need for a court-appointed conservatorship, providing a smooth transition in case of disability.
